6. Jobsite Liability & Limitations of Underground Locating

6.1 No Utility Locator Can Guarantee All Subsurface Conditions

By the nature of the industry, no private utility locating provider can guarantee the detection or accuracy of all buried utilities or objects. Soil conditions, depth, material type, congestion of lines, inaccessible areas, abandoned utilities, or inaccurate as-builts may limit the effectiveness of locating technology.

Liberty Locating performs all services using nationally accepted locating methods and industry-standard equipment. We commit to exercising the highest reasonable level of skill and care. However, we cannot guarantee that all utilities, structures, or obstructions will be discovered, identified, or accurately marked.

6.2 Client Responsibility & Jobsite Safety

The client acknowledges and agrees that:

  • Liberty Locating provides locating assistance, not excavation clearance

  • Our markings are interpretations based on detectable signals and accessible conditions

  • The client remains fully responsible for safe digging practices, exposure methods, and confirming utilities prior to excavation

  • Vacuum excavation, hydro excavation, or hand digging may be required to positively verify utility locations

  • The client is responsible for contacting 811 for public utilities before project commencement

Failure to adhere to safe excavation practices may result in damage, injury, or liability for which Liberty Locating is not responsible.

6.3 No Warranty of Completeness

Liberty Locating does not warrant, represent, or guarantee:

  • That all utilities will be detected

  • That marking locations are exact

  • That depth estimations are perfectly accurate

  • That undocumented, abandoned, or private lines will be identifiable

  • That non-conductive or deeply buried materials will be detectable

Our service is based on best-effort locating practices, not absolute certainty.

6.4 Limitation of Liability

To the fullest extent permitted by law, Liberty Locating’s liability shall be limited to the amount paid for the specific service performed. We are not liable for:

  • Damages resulting from inaccurate or incomplete utility information

  • Site conditions outside our control
