Liberty Locating, LLC

1. Acceptance of Terms

By accessing or using the Liberty Locating, LLC (“Liberty Locating,” “we,” “our,” or “us”) website, submitting an inquiry, creating an account, or engaging any services provided by Liberty Locating, you agree to be legally bound by these Terms of Use. If you do not agree with these Terms, do not use this website or our services.

Your continued use of the website or any Liberty Locating service constitutes acceptance of these Terms.

2. Scope of Services

Liberty Locating provides private utility locating services using industry-standard equipment and techniques. Our website and online systems may allow you to request quotes, schedule appointments, review documentation, or obtain project-related information.

These Terms apply to:

  • Your use of our website

  • Your submission of project information

  • Any communication or interaction with Liberty Locating

  • Your engagement of our field services

Separate agreements or work orders may apply to specific projects.

3. No Guarantee of Subsurface Accuracy

Underground utility locating is inherently limited. You acknowledge and agree that:

  • No locating provider can guarantee 100 percent detection of all subsurface utilities or obstructions

  • Soil conditions, utility materials, depth, interference, inaccessibility, and unknown or abandoned utilities can prevent detection

  • Markings are interpretations of detectable signals, not precise engineering data

  • All depths and locations are approximate unless explicitly stated otherwise

  • Additional verification, including vacuum or hand excavation, is required for confirmation

Liberty Locating is not responsible for damages arising from utilities or structures that were not detectable, not marked, inaccurately marked, or not accessible at the time of service.

4. Client Responsibilities

By using our services, you agree to:

4.1 Contact 811 Before Any Excavation

The client must request public utility marking through 811 before any excavation. Liberty Locating’s services do not replace mandatory public utility locating.

4.2 Provide Accurate Information

You are responsible for providing correct site addresses, drawings, access details, job hazards, and contact information.

4.3 Maintain Jobsite Safety

The client is solely responsible for:

  • Safe digging practices

  • Exposing utilities through approved methods

  • Compliance with local, state, and federal regulations

  • Protecting Liberty Locating personnel from hazards

4.4 Interpret Markings Correctly

Field markings are subject to interpretation. Liberty Locating is not liable for misinterpretation of paint, flags, drawings, or verbal explanations once our technician leaves the site.

5. Limitations of Liability

To the fullest extent permitted by law:

  • Liberty Locating’s liability is limited to the amount paid for the specific service performed

  • We are not responsible for any indirect, incidental, consequential, special, or punitive damages

  • We are not responsible for damages caused by undiscovered or inaccurately located utilities

  • We do not guarantee the accuracy, completeness, or reliability of site data, client-provided information, as-built records, or third-party reports

Your use of our services confirms your understanding of the inherent risks of underground utility locating.
